On Official Statistical Accounting and State statistics system in the Russian Federation

Article 1 Purpose and Subject of regulation of this Federal Law

1. Purpose of this Federal Law is creation of legal basis for implementation of the unified governmental policy in the field of official statistical accounting aimed to satisfy information needs of the state and society in comprehensive, reliable, scientifically based and timely submitted official statistical information about social, economic, demographic, ecological and other public processes in the Russian Federation.

2. This Federal Law shall regulate social relations arising during official statistical accounting.

3. This Federal Law shall apply to respondents, subjects of official statistical accounting and users of the official statistical information.

Article 2. Major Definitions Used in this Federal Law

For the purpose of this Federal Law the following major definitions shall be used:

1) official statistical accounting - activities aimed to conduct federal statistical observation, according to official statistical methodology, and processing of data obtained as a result of this monitoring, and conducted in order to compile official statistical information;

2) state statistics system - public federal information statistics system, which is an combination of primary statistical data and administrative data allowing to exercise official statistical accounting, official statistical information compiled on their basis in compliance with official statistical methodology, and information technologies and technical facilities providing for compilation of such information;

3) official statistical information - summarized aggregated documented information on the quantitative component of social, economic, demographic, ecological and other social processes in the Russian Federation, compiled by the subjects of official statistical accounting in compliance with official statistical methodology;

4) subjects of official statistical accounting - federal authorities, other federal state bodies, compiling official statistical information in appropriate filed of activities in compliance with legislation of the Russian Federation;

5) federal statistical observation - collecting of primary statistical data and administrative data by subjects of official statistical accounting;

6) administrative data - documented information used in compiling of official statistical information, obtained by the federal authorities, other federal state bodies state authorities of the subjects of the Russian Federation, other public bodies of the subjects of the Russian Federation, local self-government bodies, public organizations in connection with exercise of their permitting, registration, control and supervision, other administrative functions, as well as by other organizations to which these functions are assigned by legislation of the Russian Federation;

7) primary statistical data - documented information according to the federal statistical observation form, obtained from respondents, or information documented right in the course of federal statistical observation;

8) users of official statistical information - state authorities, local self-government bodies, legal entities and physical persons addressing the state statistics system or subjects of official statistical accounting for the necessary statistical information and/or using such information.

Article 3. Legal Regulation of Official Statistical Accounting and State statistics system

1. Legal regulation of official statistical accounting and state statistics system is based on the Constitution of the Russian Federation, international treaties of the Russian Federation and shall be exercised by this Federal Law, other federal laws, normative legal acts adopted in compliance therewith by President of the Russian Federation and Government of the Russian Federation, as well as normative legal acts of federal authorities.

2. Legal regulation of relations pertaining to the search, processing, provision and dissemination of official statistical information, provision of its security, application of information technologies and other aspects of creation and operation of the state statistics system, not regulated by this Federal Law, shall be exercised according to Federal Law No. 149-ФЗ "On information, information technologies and information security" dated July 29, 2006, as well as by other federal laws and other normative legal acts of the Russian Federation.

Article 4. Principles of Official Statistical Accounting and State statistics system

Principles of official statistical accounting and state statistics system shall be as follows

1) comprehensive, reliable, scientifically based and timely submitted and generally available official statistical information (except for information limited by the federal laws);

2) use of scientifically based official statistical methodology corresponding to the international standards and principles of official statistics, as well as to legislation of the Russian Federation, openness and accessibility of such methodology;

3) rational source selection in order to compile official statistical information to provide for its completeness, reliability and punctual submission, as well as to reduce burden on respondents;

4) opportunity to compile official statistical information across the Russian Federation as whole, subjects of the Russian Federation, municipalities;

5) guarantee of confidentiality of the primary statistical data during official statistical accounting and their use for compilation of official statistical information;

6) coordinated actions of the subjects of official statistical accounting;

7) use of common standards in the use of information technologies and all-Russia classifications of technical, economic and social information for creation and use of the state statistics system to make compatible with other state information systems;

8) provision of safety and security of official statistical information, primary statistical data and administrative data.

Article 5. Official Statistical Accounting

1. Official statistical accounting in the Russian Federation shall be exercised by the subjects of official statistical accounting.

2. Subjects of official statistical accounting shall exercise powers of the holders of official statistical information compiled by these subjects, on behalf of the Russian Federation.

3. Subjects of official statistical accounting shall be operators of the state statistics system.

4. State statistics system shall use the following kinds of documented information: official statistical information, primary statistical data, administrative data.

5. Official statistical accounting shall be exercised in compliance with the federal plans of statistical operations, to be worked out by a federal executive authority, authorized by the Government of the Russian Federation, together with the subject of official statistical accounting and shall be approved by the Government of the Russian Federation. Resolution on updating (correction) of the federal plan of statistical works shall adopted by the Government of the Russian Federation on provision by the federal executive authority, authorized by the Government of the Russian Federation.

6. Federal plan of statistical operations shall contain a list of subjects of official statistical accounting and works performed thereby on compiling official statistical information with a periodicity of each operation, aggregation level of official statistical information (on the Russian Federation in general, on the subjects of the Russian Federation, on municipalities), grouping of this information according to the classification parameters and deadlines for its provision to the users of official statistical information or dissemination.

7. Federal plan of statistical works shall be worked out proceeding from a rational choice of sources in order to compile official statistical information providing its completeness, reliability, scientific substantiation, punctual provision, provision of interests of the users of official statistical information, as well as in order to reduce burden on respondents and avoid overlapping in the work of subjects of official statistical accounting.

8. Activities in the field of official statistical accounting shall be coordinated by a federal executive authority authorized by the Government of the Russian Federation during development of the federal plan of statistical works, preparation of suggestions on its updating and approval of forms for federal statistical observation and instructions on their filling-in.

9. To compile official statistical information the subjects of official statistical accounting shall obtain primary statistical data and administrative data from respondents, including those containing data referred to the national secret, data referred to a commercial secret, information on taxpayers, personal data on physical persons with their compulsory impersonification, and other data access to which is limited by the federal laws, and shall provide for information security in compliance with legislation of the Russian Federation concerning these categories of restricted information.

10. Official statistical information shall be generally available, except for information access to which is limited by federal laws. Access of the interested users of official statistical information to the state official statistical information shall be provided through its provision or dissemination.

11. Official statistical information shall be disseminated by the subjects of official statistical accounting by way of its publication in official publications of the subjects of official statistical accounting, mass media and its placement in public information telecommunication networks, including for free access at official web-sites of the subjects of official statistical accounting.

12. Subjects of official statistical accounting shall compulsory submit the official statistical information free of charge to President of the Russian Federation, Federal Assembly of the Russian Federation and Government of the Russian Federation. Official statistical information shall be also provided by the subjects of official statistical accounting free of charge to other federal authorities, as well as state authorities of the subjects of the Russian Federation, local self-government bodies, courts, prosecutor's offices, Bank of Russia, public non-budgetary funds, trade unions and employers' unions on their written request or in compliance with an agreement on information cooperation.

Article 6. Federal statistical observation

1. Depending on the methodology, federal statistical observation may be total (concerning all subjects/objects) of the aggregation in question (census) and sample (concerning particular subjects/objects) of the aggregation in question basing on a representative sample, fully and adequately reflects the characteristics of population of units. Methodology for federal statistical observation shall be determined by the subjects of official statistical accounting, unless otherwise stipulated by the federal laws.

2. Federal statistical observation shall concern respondents, which shall be legal entities, established in the territory of the Russian Federation, state authorities and local self-government bodies, affiliates, representative offices, divisions of foreign companies conducting activities in the territory of the Russian Federation, citizens of the Russian Federation, foreign citizens and people without citizenship staying in the territory of the Russian Federation and citizens conducting business without establishment of a legal entity in the territory of the Russian Federation.

3. Primary statistical data shall be collected according to the forms of federal statistical observation. Form of federal statistical observation is a specimen of a statistical document designated to obtain primary data, according to the established procedure, containing questions of the monitoring program, place for answers thereto, as well as requisite elements for signature of the official in charge of statistical information provision (person authorized to provide official statistical information on behalf of the legal entity or on behalf of the citizen conducting business activities without establishment of a legal entity in the territory of the Russian Federation) and allowing to unify the process of statistical information collecting and automatic processing.

4. Forms of federal statistical observation and instructions on their filling-in shall be approved by a federal executive authority authorized by the government of the Russian Federation to represent subjects of official statistical accounting, unless otherwise stipulated by the federal laws.

5. Primary statistical data shall be collected during federal statistical observation by way of providing these data to respondents, or by way of respondents interviewing, or by way of registration of appropriate facts by the persons engaged in collecting of primary statistical data. Methodology for the primary statistical data collecting shall be determined by the subjects of official statistical accounting, unless otherwise stipulated by the federal laws.

6. Operations pertaining to the federal statistical observation shall be performed by legal entities and physical persons engaged in these operations on a contractual basis in compliance with legislation of the Russian Federation.

Article 7. Official statistical methodology

1. Official statistical methodology shall be compulsory applied at compilation of official statistical information.

2. Official statistical methodology shall include methodology for collecting, control, editing, summarizing and grouping of the primary statistical data and administrative data, assessment of accuracy of statistical information and its systematization.

3. Official statistical methodology shall be formed by the subjects of official statistical accounting and shall be approved thereby upon coordination with the federal executive bodies authorized by the Government of the Russian Federation.

Article 8. Provision of Primary Statistical Data and Administrative Data to the Subjects of Official Statistical Accounting

1. Respondents, except for respondents described in part 2 and 3 of this Article, should provide subjects of official statistical accounting, gratis, with primary statistical data and administrative data necessary to compile official statistical information, including the data containing information making the national secret, information making commercial secret, information on the taxpayers, personal data on physical persons with their compulsory impersonification, and other data access to which is limited by the federal laws.

2. Respondents - citizens of the Russian Federation, foreign citizens and people without citizenship staying in the territory of the Russian Federation, in respect of whom federal statistical observation is conducted, shall submit to the subjects of official statistical accounting the primary statistical data, necessary to compile official statistical information free of charge and on a voluntary basis, unless otherwise stipulated by the federal laws.

3. Respondents - citizens conducting business without establishment of a legal entity in the territory of the Russian Federation in respect of whom federal statistical observation is conducted, shall submit to the subjects of official statistical accounting the primary statistical data, related to their business activities and necessary to compile official statistical information, free of charge, including information making the national secret, information making commercial secret.

4. Respondents - subjects of small and medium-sized business entities shall submit to the subjects of official statistical accounting the primary statistical data according to a simplified procedure in compliance with Federal Law No. 209-ФЗ dated July 24, 2007 "On development of minor and average-size business entities in the Russian Federation".

5. Primary statistical data and administrative data containing information referred to the national secret, information referred to a commercial secret, information on taxpayers, personal data on physical persons with their compulsory impersonification, and other data access to which is limited by the federal laws, shall be provided in compliance with legislation of the Russian Federation on these categories of restricted information.

6. Legal entities that have subdivisions shall submit primary statistical data to the subjects of official statistical accounting according to the established procedure on both legal entities and on such divisions.

7. Primary statistical data documented according to the forms of federal statistical observation may be provided by respondents to the subjects of official statistical accounting on paper or on electronic media in compliance with legislation of the Russian Federation.

8. Forms of federal statistical observation duly approved according to the procedure stipulated by this Federal Law and instruction for their filling-in shall be provided to the respondents by the subjects of official statistical accounting free of charge.

9. Terms and conditions for compulsory submission of primary statistical data and administrative data to the subjects of official statistical accounting shall be defined by the Government of the Russian Federation, unless otherwise stipulated by the federal laws.

Article 9. Protection guarantee of the Primary Statistical Data Contained in the Federal statistical observation Forms

1. Primary statistical data contained in the forms of federal statistical observation shall be restricted information, except for information, access to which should not be limited in compliance with federal laws. Subjects of official statistical accounting should provide for confidentiality of the restricted information. Primary statistical data making restricted information should not be disclosed or disseminated and shall be used only to form official statistical information.

2. Primary statistical data contained in the forms of federal statistical observation shall be processed in conditions guaranteeing protection of such data, in compliance with legislation of the Russian Federation, against unauthorized access, prevention of their theft, loss, falsification or distortion.

3. Should officials, as well as persons, who by virtue of their office of scope of activities had access to the primary statistical data contained in the forms of federal statistical observation, lose the same, unlawfully disclosed or disseminated these data, or helped their falsification, these people will bear disciplinary, civil, administrative or criminal responsibility in compliance with legislation of the Russian Federation.
